Swallows FC have reached an agreement with the two Serbian players who got the club banned by Fifa from registering players for two years.
Swallows will have to fork out R600000 and pay Obren Cuckovic and Vladimir Mandic R300 000 each so that they can have their transfer ban lifted by the world’s football mother body.
The duo played for the old Moroka Swallows in the 2014/2015 campaign.
Swallows FC owner David Mogashoa and legal representative Leruma Thobejane have accepted the final offer of €15 000 (R300 000) for each player to settle the matter.
This comes after the duo had taken the old Moroka Swallows to Fifa. Their primary claim was that Swallows owed them money and never paid their salaries according to their contracts. Because the club was struggling financially, it then terminated their contracts.
“Let me clarify the matter. The two players in question are Moroka Swallows players, not Swallows FC players,” said Thobejane.
“In terms of our own football rules in the NSL Handbook, Swallows FC has no relations with Moroka Swallows. Having bought the status of Maccabi FC, Swallows FC is a new entity and is a trading name of a company that purchased Maccabi. So, any player or coach who was owed money by Maccabi can claim money from Swallows FC. When I took the case, there was a judgment or a decision by the Fifa Players Status Committee where two players who used to play for a team called Moroka Swallows in 2014/2015, long before Swallows FC existed. They took Moroka Swallows to Fifa and they were awarded certain financial compensation in terms of the contract they had with Moroka Swallows. We appealed the decision to CAS,” said Thobejane.
He is accusing Safa of blundering and supplying Fifa with wrong information regarding the position of the two Swallows entities.
“In Fifa’s motivation for the ban, they relied on a letter from Safa that links Swallows FC with Moroka Swallows. The rule book says that the two Swallows are two different entities. We are not supposed to be paying money to these guys but because someone at Safa created a blunder and it is now costing Swallows FC,” he said.
According to Thobejane, they have accepted the two players’ demands but will pay the settlement without admission of liability to stop litigation and make the case disappear.
“These guys were not honest. We are agreeing for the sake of settling. We did not want to waste time in courts and we accepted their initial proposal in good faith.”
“The first payment was 6,500 Euros (R115 000) for each player. Then we got a letter saying that there was no settlement paid. That money is gone, we lost it.
“Remember when you effect an international payment, that money is subjected to treasury clearance. The payment was made in time and it took about six days to reflect from their side.”
