African National Congress (ANC) as known as the ruling party its lawyers will challenge Ace Magashule.
Th ruling party top leadership met on Tuesday to discuss way forward, in the light of the court action by Ace Magashule. The ANC has announced it will be challenging a legal bid by its embattled Secretary-general Ace Magashule, to oppose its contentious step-aside resolution.
“The ANC met on Monday, 17th May 2021 and affirmed the decision to oppose the application lodged by the Secretary-general and Comrade Ace Magashule to have, among others, his temporary suspension lifted.“ Said spokesperson Pule Mube in the statement.
The ANC is definitely taking Ace Magashule’s legal team very seriously, having acquired the service of prominent advocates, including Wim Trengrove SC, who has represented Public Enterprise Minister Pravin Gordhan on the SARS rogue unit saga against Public Protector Advocate Busisiwe Mkhwebane, among several types of noteworthy legal matters.
“The ANC has appointed Ledwaba Mazwai Attorneys as instructing attorneys supported by the following three Senior Counsels and one Junior Counsel respectively : Adv Wim Trengrove SC, Adv Ngwako Maenetje SC, Adv Fana Nalane SC and Adv Buhle Lekokotla.“ Said Pule.
Ace Magashule was suspended after he refused to abide by its step-aside resolution, which directs members who face serious and corruption charges before the court, temporarily to vacate the office.
Ace faces charges of fraud, money laundering and corruption in connection to a R255 million asbestos tender in the Free State, which was awarded when he was a premier minister in 2014. This means he was one of the members to which the policy applies.
In a dramatic turn of events, Magashule issued a suspension letter to the party’s president, Cyril Ramaphosa and asserted that he was still the secretary-general, despite the suspension. However, the ANC was quick to rubbish the letter, saying Magashule did not have the authority to suspend Ramaphosa, something which was later reaffirmed by the NEC during one of its meetings. The decision-making body also condemned Magashule for the letter, saying his conduct was unacceptable and a flagrant violation of the rules. He was subsequently ordered to apologise to the ANC community.
In his court papers, Ace urgues that the step-aside resolution and his subsequent suspension are unlawful and that the order for him to apologise to President Cyril Ramaphosa cannot be enforced.
